Proposed Revisions to 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, Subchapters B, H, J, M, and O

STATE BOARD OF EDUCATION: CONSENT

SUMMARY:
This item presents for first reading and filing authorization proposed revisions to 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, Subchapter B, Architecture and Construction, Subchapter H, Health Science, Subchapter J, Human Services, Subchapter M, Manufacturing, and Subchapter O, Science, Technology, Engineering, and Mathematics, to update rules, including correcting inconsistencies that have been identified in certain courses and adding new lab courses for Cosmetology.

STATUTORY AUTHORITY: Texas Education Code (TEC), §§7.102, 28.002, and 28.025, as amended by House Bill (HB) 3593 and Senate Bill (SB) 826, 85th Texas Legislature, Regular Session, 2017.

TEC, §7.102(c)(4), requires the State Board of Education (SBOE) to establish curriculum and graduation requirements.

TEC, §28.002, identifies the subjects of the required curriculum and requires the SBOE by rule to identify the essential knowledge and skills of each subject in the required curriculum that all students should be able to demonstrate and that will be used in evaluating instructional materials and addressed on the state assessment instruments.

TEC, §28.025, as amended by HB 3593 and SB 826, 85th Texas Legislature, Regular Session, 2017, requires the SBOE by rule to determine the curriculum requirements for the foundation high school graduation program that are consistent with the required curriculum under the TEC, §28.002.

EFFECTIVE DATE: The proposed effective date of the proposed revisions to 19 TAC Chapter 130, Subchapters B, H, J, M, and O, is August 27, 2018.

PREVIOUS BOARD ACTION: The SBOE adopted the Texas Essential Knowledge and Skills (TEKS) for career and technical education (CTE), including career development, effective September 1, 1998. The CTE TEKS were amended effective August 23, 2010. In April 2015 and July 2015, the board approved for second reading and final adoption proposed revisions to the CTE TEKS. At the September 2015 meeting, the board approved for second reading and final adoption proposed new CTE TEKS for an Advanced Marketing course and second-level practicum and automotive technology courses. The revised CTE TEKS were implemented at the start of the 2017-2018 school year.

Proposed revisions to 19 TAC Chapter 130, Subchapters B, H, J, M, and O, were presented to the Committee of the Full Board for discussion at the September 2017 SBOE meeting.

BACKGROUND INFORMATION AND SIGNIFICANT ISSUES:
In 2015, the SBOE adopted new CTE TEKS, which were implemented beginning with the 2017-2018 school year. Since the time of adoption, inconsistencies in the TEKS have been identified. Inconsistencies include prerequisite requirements, amount of credit, and duplicate or unclear student expectations. Additionally, in November 2016 the board requested that staff prepare proposed TEKS for two laboratory courses in Cosmetology that could be available to districts to award a total of three credits each in Cosmetology I and II.

This item provides the opportunity for the SBOE to consider for first reading and filing authorization proposed revisions to the CTE TEKS to correct inconsistencies and add new Cosmetology laboratory courses. Attachment II reflects the text of proposed revisions to 19 TAC Chapter 130, Subchapters B, H, J, M, and O.

FISCAL IMPACT: The Texas Education Agency has determined that there are no additional costs to persons or entities required to comply with the proposed revisions. In addition, there is no direct adverse economic impact for small businesses, microbusinesses, or rural communities; therefore, no regulatory flexibility analysis, specified in Texas Government Code, §2006.002, is required. There is no effect on local economy for the first five years the proposed revisions are in effect; therefore, no local employment impact statement is required under Texas Government Code, §2001.022. The proposed revisions do not impose a cost on regulated persons and, therefore, are not subject to Texas Government Code, §2001.0045.

GOVERNMENT GROWTH IMPACT:
The TEA staff has determined that the proposed revisions do not have a government growth impact pursuant to Texas Government Code, §2001.0221.

PUBLIC AND STUDENT BENEFIT: Benefits include added flexibility in Cosmetology course options for students and districts and in prerequisites for certain CTE courses.

PROCEDURAL AND REPORTING IMPLICATIONS:
The proposed revisions would have no new procedural and reporting implications.

LOCALLY MAINTAINED PAPERWORK REQUIREMENTS: The proposed revisions would have no new locally maintained paperwork requirements.

PUBLIC COMMENTS: The official public comment period will begin when the proposal, approved for first reading and filing authorization, is published in the Texas Register.

ALTERNATIVES: None.

OTHER COMMENTS AND RELATED ISSUES:
A request for a public hearing on the proposal submitted under the Administrative Procedure Act must be received by the commissioner of education not more than 14 calendar days after notice of the proposal has been published in the Texas Register.

Proposed Amendment to 19 TAC Chapter 130, Texas Essential Knowledge and Skills for Career and Technical Education, Subchapter C, Arts, Audio/Video Technology, and Communications, §130.121, Extended Practicum in Fashion Design (Two to Three Credits), Adopted 2015, is presented for second reading and final adoption as a separate item in this agenda.
