1. Commissioner's Comments

This item provides an opportunity for the board to be briefed on current agenda items, agency operations, policy implementation, and public education-related legislation.

2. Permanent School Fund Percentage Distribution Rates Under Consideration for Fiscal Years 2028 and 2029

This item provides an opportunity for the State Board of Education (SBOE) to discuss a range of Permanent School Fund (PSF) percentage distribution rates to the Available School Fund (ASF) under consideration for fiscal years 2028 and 2029.  Pursuant to the Texas Constitution, Article VII, the SBOE is authorized to adopt an annual distribution rate before the regular session of the Texas legislature convenes in January 2027. The SBOE will consider various factors associated with the distribution rate such as expected returns, inflation, and student population change. Statutory authority is the Texas Constitution, Article VII, §2 and §5; and 19 Texas Administrative Code (TAC) Chapter 33.

3. Consideration of the Commissioner of Education's Generation 31 Open-Enrollment Charter School Proposals

This item provides the committee and board an opportunity to review and take action or no action on the commissioner’s list of proposed Subchapter D Open-Enrollment Charter Schools scheduled to open in the 2027-2028 school year. If awarded, the charters will have an initial five-year term. Statutory authority is the Texas Education Code (TEC), §12.101.
