Consideration of IMRA Cycle 2025 Proposed Rejected List and Existing List of Rejected Instructional Materials

SUMMARY: This item provides an opportunity for the State Board of Education (SBOE) to move instructional materials from the List of Proposed Rejected Instructional Materials to the List of Rejected Instructional Materials if publishers of those programs did not submit changes in response to the IMRA Cycle 2025 Proclamation for Proposed Rejected Instructional Materials.
STATUTORY AUTHORITY: Texas Education Code (TEC), §31.022 and §31.023.
TEC, §31.022, as amended by HB 100, 89th Texas Legislature, Regular Session 2025, requires the SBOE to review instructional materials that have been provided to the board by the Texas Education Agency (TEA) under TEC, §31.023 and add the material to a list of proposed rejected instructional materials and issue a proclamation requesting the revision of the applicable instructional material before the end of the 45-day period.
TEC, §31.023, requires the commissioner of education to establish, in consultation with and with the approval of the SBOE, a process for the annual review of instructional materials by TEA. In conducting a review under this section, TEA must use a rubric developed by TEA in consultation with and approved by the SBOE. PREVIOUS BOARD ACTION: At the December 2023 meeting, the Board approved the IMRA process.At the November 2025 meeting, the board voted to add instructional materials to the lists of approved and rejected instructional materials. The board also issued the IMRA Cycle 2025 Proclamation for Proposed Rejected Instructional Materials to request that publishers with materials placed on the List of Proposed Rejected Instructional Materials submit proposed revisions to instructional materials no later than January 6, 2026.
BACKGROUND INFORMATION AND JUSTIFICATION: Subsection (b-1) of §31.022, as added by HB 100, 89th Regular Legislature 2025, directs the SBOE to issue a proclamation requesting revisions to instructional materials identified for proposed rejection not later than the 45th day before the date the Board intends to add such materials to the official list of rejected instructional materials.
The IMRA process for Cycle 2025 identified certain instructional materials that do not meet the required standards for alignment with the Texas Essential Knowledge and Skills (TEKS), English Language Proficiency Standards (ELPS), suitability standards, quality standards, phonics rule compliance, factual accuracy, accessibility, or other criteria established by the SBOE. Therefore, the Board seeks to provide publishers with an opportunity to correct deficiencies and ensure compliance with statutory and regulatory requirements before final Board action.
Publishers who failed to submit revisions by the stated deadline in the Proclamation will have their materials added to the official List of Rejected Instructional Materials, as required by TEC, §31.022(a).
Board members also requested an opportunity to take action on instructional materials on the existing List of Rejected Instructional Materials.
MOTION TO BE CONSIDERED: The State Board of Education:
Add instructional materials from publishers who failed to submit revisions by the proclamation deadline to the official List of Rejected Instructional Materials, as required by TEC, §31.022(a); and
Remove instructional materials from the List of Rejected Instructional Materials as presented
