1. Adoption of Review of 19 TAC Chapter 89, Adaptations for Special Populations 
(Adoption of Review)

Texas Government Code, §2001.039, establishes a four-year rule review cycle for all state agency rules, including State Board of Education (SBOE) rules. This item presents the adoption of the review of 19 Texas Administrative Code (TAC) Chapter 89, Adaptations for Special Populations. The rules being reviewed relate to gifted/talented education, Texas certificate of high school equivalency, and special education services and settings. The statutory authority for the rule review is TGC, §2001.039. The statutory authority for 19 TAC Chapter 89, Subchapter A, is Texas Education Code (TEC), §§29.121; 29.122; 29.123; 39.236; and 48.109; for Subchapter C is TEC, §7.111; and for Subchapter D is TEC, §30.003 and §30.004, as amended by House Bill (HB) 2 and Senate Bill (SB) 568, 89th Texas Legislature, Regular Session, 2025.

2. Discussion of Proposed Repeal of 19 TAC Chapter 89, Adaptations for Special Populations, Subchapter D, Special Education Services and Settings, §89.62,  Support of Students Enrolled in the Texas School for the Blind and Visually Impaired and Texas School for the Deaf 

This item provides the opportunity for the committee to discuss the proposed repeal of 19 Texas Administrative Code (TAC) Chapter 89, Adaptations for Special Populations, Subchapter D, Special Education Services and Settings, §89.62, Support of Students Enrolled in the Texas School for the Blind and Visually Impaired and Texas School for the Deaf. The proposal would repeal §89.62 as the State Board of Education's (SBOE's) statutory authority for the rule was removed by House Bill (HB) 2 and Senate Bill (SB) 568, 89th Texas Legislature, Regular Session, 2025.  Statutory authority is the Texas Education Code (TEC), §30.003 and §30.004, as amended by HB 2 and SB 568, 89th Texas Legislature, Regular Session, 2025.

3. Proposed Amendment to 19 TAC Chapter 74, Curriculum Requirements, Subchapter C, Other Provisions, §74.27, Innovative Courses and Programs
(Second Reading and Final Adoption)

This item presents for second reading and final adoption a proposed amendment to 19 Texas Administrative Code (TAC) Chapter 74, Curriculum Requirements, Subchapter C, Other Provisions, §74.27, Innovative Courses and Programs. The proposed amendment would update the process for review and approval of proposed innovative courses and sunset of existing courses and would update requirements for implementation of approved innovative courses.  No changes are recommended since approved for first reading. Statutory authority is the Texas Education Code (TEC), §28.002(f).

4. Approval of Updates and Substitutions to Approved Instructional Materials

This item provides an opportunity for the committee and board to approve update and/or substitution requests received for State Board of Education (SBOE)-adopted or approved products. The updated content has been posted for public review. Statutory authority is the Texas Education Code (TEC), §31.003 and §31.022.

5. Proposed Repeal of 19 TAC Chapter 74, Curriculum Requirements, Subchapter A, Required Curriculum, §74.4, English Language Proficiency Standards 
(Second Reading and Final Adoption)

This item presents for second reading and final adoption the proposed repeal of 19 Texas Administrative Code (TAC) Chapter 74, Curriculum Requirements, Subchapter A, Required Curriculum, §74.4, English Language Proficiency Standards. The proposed repeal would remove the English Language Proficiency Standards (ELPS) for Kindergarten-Grade 12 in §74.4 that will be superseded by 19 TAC §120.20, English Language Proficiency Standards, Kindergarten-Grade 3, Adopted 2024, and §120.21, English Language Proficiency Standards, Grades 4-12, Adopted 2024, beginning with the 2026-2027 school year. No changes are recommended since approved for first reading. Statutory authority is the Texas Education Code (TEC), §§7.102(c)(4), 28.002(a) and 29.051.

6. Proposed Amendment to 19 TAC Chapter 74, Curriculum Requirements, Subchapter B, Graduation Requirements, §74.14, Performance Acknowledgments 
(Second Reading and Final Adoption)

This item presents for second reading and final adoption a proposed amendment to 19 Texas Administrative Code (TAC) Chapter 74, Curriculum Requirements, Subchapter B, Graduation Requirements, §74.14, Performance Acknowledgments. The proposed amendment would update the minimum score required for a performance acknowledgement on the SAT,  align language related to ACT with language related to SAT, and add the Classic Learning Test® and Preliminary SAT (PSAT) 10 to appropriate performance acknowledgments. No changes are recommended since approved for first reading. Statutory authority is the Texas Education Code (TEC), §7.102(c)(4) and §28.025(c-5).
